What is a BMC-84 freight broker surety bond?
FMCSA identifies a $75,000 BMC-84 surety bond or BMC-85 trust fund agreement as financial security for brokers. Luis’s lesson explains why this requirement matters to the working relationship between brokers and carriers.
The amount of the bond is not the annual price of obtaining it, and it is not money available for ordinary brokerage expenses. Obtain a current proposal and understand the agreement rather than relying on the historical premium examples in the video.
Understand who the security is intended to protect
Eligible unpaid claims can be presented to the financial-security provider for review. The provider evaluates the claim and the supporting facts; filing does not automatically establish that the full requested amount is owed.
For the brokerage, the important point is that a surety arrangement does not make an unpaid obligation disappear. Read the indemnity and reimbursement terms and understand what a claim or payment can require of the business.
Compare the actual terms before choosing a provider
Ask about premium, collateral if required, renewal, cancellation and the responsibilities created by the agreement. Verify that the filing meets the applicable requirement and that your business information is accurate.
A lower advertised price does not explain the entire arrangement. Compare current written proposals and ask a qualified adviser about terms you do not understand. Keep the provider’s contact information and renewal responsibilities accessible.
Keep up with current financial-responsibility requirements
FMCSA’s changes effective January 16, 2026 address matters including eligible trust assets and action when available security falls below the required amount. Consult the agency’s current compliance guidance for the details that apply to your filing.
Financial security is one part of a functioning brokerage. Accurate billing, credit controls, payment follow-through and complete records still matter every day. Treat the bond as a requirement to understand and maintain, rather than a substitute for those operating habits.
